Expert Review of Draft Regulatory Legal Acts

Ashyk Kogam Public Foundation «Social Development and Innovation Fund» is recognized by the central state bodies of the Republic of Kazakhstan as an entity authorized to conduct expert review of draft regulatory legal acts affecting the interests of private entrepreneurship.

In accordance with paragraph 4 of Article 64 of the Entrepreneurial Code of the Republic of Kazakhstan and the Accreditation Rules approved by Order No. 127 of the Minister of National Economy of the Republic of Kazakhstan dated June 29, 2023, the Foundation has been accredited and is a member of expert councils on private entrepreneurship issues under the following central state bodies:

Expertise and Public Oversight Activities

The following activities are enshrined in the Charter of Ashyk Kogam Public Foundation «Social Development and Innovation Fund»

Public Control and Monitoring
Charter clause 2.1.20

Participation in public oversight through monitoring government procurement, quasi-public sector procurement, budget spending, national project implementation, compliance with information accessibility legislation, conducting public expert reviews and inspections, as well as volunteer and anti-corruption activities.

Sociological Research
Charter clause 2.1.21

Organization and conducting of public opinion polls, sociological and marketing research on issues of public and commercial interest.

Government Procurement Analysis
Charter clause 2.1.22

Analysis and monitoring of government procurement processes and quasi-public sector procurement, including preparation of analytical reports, recommendations and proposals aimed at increasing their transparency and efficiency.

Expert Opinions on Draft Laws
Charter clause 2.1.23

Development and submission of expert opinions, proposals and recommendations on draft regulatory legal acts, orders, programs and other decisions affecting public and social interests, rights and freedoms of citizens and legal entities.

Legislative Participation
Charter clause 2.1.24

Participation in discussions of draft laws and other regulatory legal acts, as well as in the work of working groups, commissions and consultative-advisory bodies under state bodies, maslikhats of all levels, and in the Majilis and Senate of Parliament.

Partner Collaboration
Charter clause 2.1.25

Cooperation with state bodies, institutions, legal entities and individuals, international organizations and other civil society institutions for the implementation of the Foundation's statutory objectives.

Legal Basis of Accreditation

Accreditation is conducted in accordance with paragraph 4 of Article 64 of the Entrepreneurial Code of the Republic of Kazakhstan and the Rules for Accreditation of associations of private entrepreneurship subjects and other non-profit organizations, approved by Order No. 127 of the Minister of National Economy of the Republic of Kazakhstan dated June 29, 2023.

Accredited organizations are recognized by central and local executive bodies as having the right to represent the interests of private entrepreneurship subjects in expert councils on entrepreneurship issues. The accreditation certificate is issued for three years with the right to obtain an indefinite certificate after two consecutive accreditations.
